Gender-based violence is violence directed against Gender-based violence is violence directed against a person because of their gender; or violence that disproportionately affects person of a certain gender.
GBV can physical, psychological or sexual.

In the workplace it’s the employer’s responsibility to create a safe space.

Here are three steps to help address GBC at work:
1. Identify the potential risks and its causes;
2. Commit to equality and diversity – having females in  leadership positions goes a long way to challenge the root of the problem -- gender inequality;
3. Make sure you have effective and clear grievance policies in place.

South African Law supports the right to choose. South African Law supports the right to choose.

The Choice on Termination of Pregnancy Act helps to reduce unsafe backstreet abortions by allowing women to have abortions under the following circumstances:
1. If the pregnancy is less than 13 weeks
2. If the pregnancy are between 13 and 20 weeks and there are:
a. mental or physical health dangers involving the mother or fetus
b. pregnancy are due to incest or rape
c. the mother believes her economic or social status is reason for termination
3. Over 20 weeks only if there life threatening dangers or severe birth defects.

A women will be advised to consult her partner or parents (if she is under 18) but no additional consent is required.

Now, how does all this relate to the workplace?

Honestly, thanks to our liberal legal protection of abortion rights in South Africa, as an employer there isn’t much to do.
Should it become known that an employee had or are going to have an abortion, the information needs to be treated as any other personal information… so don’t spread it. Allow the requested sick leave (or annual leave if her sick days are depleted).
 And don’t treat her differently, even if you don’t agree with abortion.

I could write several pages on all the ways women I could write several pages on all the ways women are still disadvantaged in South Africa.
But instead I’m choosing – for today at least – to focus on all the things we are getting right.

Section 9 of the Bill of Rights (that’s the big law in SA about our rights as humans).
So section 9 is all about equality and it states clearly that discrimination by the state based on gender, sex, marital status or pregnancy– and a bunch of other stuff – is not allowed. This gives specific protection to women.

Constitutional Court Judgments.
If you’re unsure the Constitutional Court is the top dog of south African courts. And there are several judgments handed down by this court that affirms women’s rights.

And we also have several legislation that protects women, most notable:

The Choice on Termination of Pregnancy Act.
The Act says a woman who wishes to may terminate a pregnancy in the first 12 weeks. From week 13 to week 20, abortion is available if a doctor advises, and after that only if there is risk to the woman or the fetus.

And The Domestic Violence Act
The legislation broadens the definition of domestic violence to include not only married women and children, but unmarried women who are involved in relationships or living with their partners, people in same-sex relationships, mothers and their sons, and other people who share a living space.

Although I know that judgments and laws cannot stop a flying fist, they are the first steps in creating a society where women are truly equal.
South Africa faces an uphill battle when it comes to protecting its women, but at least we can breathe easier knowing that we have some of the most comprehensive legislation and court judgements in the world protecting women's rights.

Trust income may be taxed in the hands of either:
• The donor
• Beneficiary or

When the trust is taxed a flat rate of 45%

Special trusts are taxed on a sliding scale from 18% to 45%, this is the same as a natural person.

Trusts as such do not qualify for rebates as per Section 6 of the Income Tax Act.

Special Trust Type A can claim certain benefits (like relief from Capital Gains Tax), but trustees would need to apply for classification from SARS before claiming.
